Terms and Conditions 


 

This page (together with the documents referred to on it) tells you the terms and conditions on which we will supply to your nail trim (Services) listed on our website www.TophersPaw.Co (our site) via our nail trim subscription services and all other services. Please read these terms and conditions carefully before subscribing to Services or engaging with our services. You should understand that by subscribing to our Services or using our services, you agree to be bound by these terms and conditions. You should print a copy of these terms and conditions for future reference. 


1. YOUR STATUS


By placing an order through our site for subscription OR services, you warrant that:


1.1 you are legally capable of entering into binding contracts; and

1.2 you are at least 18 years old.

 

2. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

 

2.1 After completing signup, you will receive an e-mail from us acknowledging that we have received your first payment for subscription to our Services. At this time, we will discuss how many pet(s) you signed up for. The service will only be eligible for the pet(s) initially registered for the service. It is not transferable or able to be used for different pet(s) each month. The subscription fee is valid for 1 (one) nail trim per month per pet(s) originally registered.


2.2 The subscription plan to our Services consists of an initial charge and then followed by recurring period charges as agreed to by you on a monthly basis. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature, and you accept responsibility for all recurring charges prior to cancellation. Topher’s Paw Co. LLC may submit periodic charges (e.g., monthly) without further authorization from you, until you provide prior notice that you have terminated this authorization or wish to change your payment method.


2.3 By subscribing to our Services you are agreeing to pay recurring subscription fee monthly for an indefinite time until cancelled by you. You can cancel your subscription at any time. You will not be charged for any cancellation. To prevent frequent subscribes and un-subscribes we have a 90-day waiting period from the date you un-subscribe until you can subscribe again. On the 91st day you can re-subscribe to our services.


2.4 Account Cancellations. If you wish to cancel your monthly subscription with us, you must cancel 3 days before your next payment is due to be collected, to avoid receiving the following months’ nail trim subscription. Customers cancelling after their payment has been taken on their monthly due date will receive the following months nail trim service as the last month as services are billed one month in advance. There are no proration refunds if you cancel anytime during the month. There is no refunds once your monthly payment has been collected. To stop your subscription, you must notify us by email at Chris@TophersPaw.Co Please provide your name and telephone number. You must cancel on or before 3 days prior to the following subscription billing date.


2.5 We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision.


2.6 We reserve the right to change our monthly subscription plan fee with a 30-day notice given to you prior to your automatic billing. If you wish to discontinue our monthly subscription service, you can cancel anytime by emailing us at Chris@topherspaw.co. The 30-day change notice can be provided to you through email, physical mail, text message, or any other means we have of contacting you to provide a full 30-day notice.

 

 

3. SCHEDULING SUBSCRIPTION SERVICE

 

3.1 After completing signup, you will receive an e-mail from us acknowledging that we have received your first payment for subscription to our Services. At that time, we will discuss scheduling your first nail trim service for the following month. Services are billed one month in advance. Services will only be offered to the same pet(s) initially registered. The services are not transferable. We will only contact you for the first month's setup. It is your responsibility to contact us via email, text, phone, our online scheduling each month to schedule your appointment.


3.2 If you fail to schedule a nail trim Service for any subscription month, there is no refunds or credits for a future month. You forfeit that month's service. 


3.3 If you must cancel your scheduled nail trim subscription Service appointment, there is no penalty or fees for such. We will reschedule during that month as availability permits. Missed months do not roll over or is any refund given for that month. 


3.4 Subscription services for nail trims are only available at our physical location, 4660 Marsh Rd. Ste 3 Okemos, MI 48864. An appointment is required for services each month.


4. PRIVACY POLICY

 

This page is used to inform website visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service, the www.TophersPaw.Co website.


If you choose to use our Service, then you agree to the collection and use of information in relation with this policy. The Personal Information that we collect are used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy.


The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at www.TophersPaw.Co, unless otherwise defined in this Privacy Policy.

We may require you to provide us with certain personally identifiable information, including but not limited to your name, phone number, and postal address. The information that we collect will be used to contact or identify you.

But, remember that no method of transmission over the internet, is 100% secure and reliable, and we cannot guarantee its absolute security. Our subscription service billing is provided by Square Inc. 7. MESSAGING TERMS & CONDITIONS


GENERAL


When you opt-in to the service, we will send you a message to confirm your signup.


By opting into messages, you agree to receive recurring automated marketing and informational text messages from Topher's Paw Co. for Topher’s Paw Co. . Automated messages may be sent using an automatic telephone dialing system to the mobile telephone number you provided when signing up or any other number that you designate.


Message frequency varies, and additional mobile messages may be sent periodically based on your interaction with Topher’s Paw Co. . Topher's Paw Co. reserves the right to alter the frequency of messages sent at any time to increase or decrease the total number of sent messages. Topher's Paw Co. also reserves the right to change the short code or phone number where messages are sent.


Message and data rates may apply. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Your wireless provider is not liable for delayed or undelivered messages.


Your consent to receive marketing messages is not a condition of purchase.


CARRIERS


Carriers are not liable for delayed or undelivered messages.


CANCELLATIONS


You can cancel any time by texting "STOP". After you send the SMS message "STOP", we will send you a message to confirm that you have been unsubscribed and no more messages will be sent. If you would like to receive messages from Topher's Paw Co. again, just sign up as you did the first time and Topher's Paw Co. will start sending messages to you again.

TRANSFER OF NUMBER


You agree that before changing your mobile number or transferring your mobile number to another individual, you will either reply “STOP” from the original number or notify us of your old number at Chris@TophersPaw.Co. The duty to inform us based on the above events is a condition of using this service to receive messages.
